Introduction

Welcome to Pinacate Beach Rentals. These Terms and Conditions govern your use of our website and the services we offer. By accessing or using our website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website.

Platform and Liability Disclaimer

1. Platform Use: Pinacate Beach Rentals is a platform to showcase units available for rent at the Pinacate. Each unit may use the property management company of their choice. Pinacate Beach Rentals is not responsible for the management, upkeep, or quality of individual units.

2. Third-Party Responsibility: Any issues related to the rental unit, including but not limited to maintenance, cleanliness, and services, are the responsibility of the respective property management company. Pinacate Beach Rentals is not liable for any disputes, damages, or issues arising from the management or condition of the rental units.

Booking and Reservation

1. Booking Process: Reservations are made directly with the management company or owner direct by choosing the "Book Through..." buttons under each unit.  A reservation is confirmed only after you receive a confirmation email from the property management company of that individual unit.

2. Payment: Full payment or a deposit, are specified during the booking process as deemed by the property management company.  If you are booking owner direct, payment will be negotiated between you and the individual owner for that unit.  You should receive confirmation from that unit's owner, regardless of the payment method.  

3. Rates: All rates are quoted in property management company links for each unit.  Pinacate Beach Rentals do not set or change prices.  If you choose to book with owner direct, the price is negotiated between you and the owner of that individual owner.  Rates are subject to change without prior notice until a reservation is confirmed by the property management company.

Cancellations and Refunds

1. Cancellation by Guest: Cancellations must be made through the property management company that your reservation was confirmed with.  Pinacate Beach Rentals does not have the ability to cancel reservations on anyone's behalf.  

Check-In and Check-Out

1. Check-In/ Check-Out: Check-In/Check-out times are set forth by each individual property management company.   

2. Identification: Valid government-issued identification is required at the gate during check-in.

Property Use

1. Occupancy: The maximum occupancy for each property is specified in the property listing and must not be exceeded.

2. Guest Rules: Guests must adhere to all rules provided in the property listing and during check-in. Failure to comply may result in eviction without a refund.

3. Damage and Loss: Guests are responsible for any damage to the property or its contents during their stay. The cost of repairs or replacements will be settled by unit property management company.

4. Noise and Conduct: Guests must respect the peace and quiet of the resort. Loud music, parties, and disruptive behavior are not allowed.

Liability and Indemnity

1. Guest Liability: Guests assume all risk and liability for personal injury, property damage, or loss during their stay.

2. Pinacate Beach Rentals Liability: We are not liable for any injury, loss, or damage incurred during your stay.

3. Indemnity: Guests agree to indemnify and hold Pinacate Beach Rentals harmless from any claims, damages, or expenses arising from their stay.

Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which the property is located. Any disputes arising from these terms or the use of our services shall be resolved in the courts of that jurisdiction.

Amendments

Pinacate Beach Rentals reserves the right to amend these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of the website constitutes acceptance of the amended terms.
